1. Our Commitment

We are dedicated to protecting the privacy of our clients, prospective clients, and website visitors. Confidentiality is a professional requirement and a vital part of building trust with the people we serve. We handle personal information, including personal health information, consistent with the Personal Information Protection and Electronic Documents Act (PIPEDA), the principles underlying the Personal Health Information Protection Act (PHIPA), Law Society of Ontario requirements, and applicable tribunal protocols.

2. Personal Information We Collect

We only collect what is necessary for representation or to respond to an inquiry, including:

  • Contact details — name, address, phone, email
  • WSIB / WSIAT / CPP-Disability claim information
  • Medical and employment evidence
  • Government identifiers where required (e.g., claim numbers)
  • Billing and payment information
  • Website usage information from visitors and prospective clients (see Section 4)

3. Why We Use Personal Information

We use information to:

  • Represent clients before WSIB, WSIAT, and Service Canada
  • Obtain and review evidence
  • Communicate with relevant parties with client authority
  • Maintain financial and regulatory records
  • Assess and respond to inquiries from prospective clients

We do not sell, trade, or improperly disclose personal information.

4. Website Visitors and Prospective Clients

This section applies to anyone who visits our website or submits an inquiry, whether or not they become a client.

  • Submitting a contact form does not create a paralegal-client relationship or the full confidentiality protections that apply once a retainer is confirmed. See our Terms and Conditions for details.
  • If we decline to act on an inquiry, we securely destroy or return the information provided within a reasonable period unless we are required to retain it (for example, to document a conflict check).
  • We use Google Analytics to understand general website traffic and usage patterns, such as which pages are visited and how visitors arrive at our site. Google Analytics uses cookies and similar technologies to collect this information, which may include IP address and device/browser information. This data is used in aggregate form and is not used to identify individual visitors for representation purposes.
  • You can control or opt out of Google Analytics tracking through your browser's cookie settings or by installing Google's opt-out browser add-on. For details on how Google handles this data, see Google's own privacy policy (policies.google.com/privacy).

5. Safeguarding Information

We ensure security by:

  • Secure locked storage for physical documents
  • Encryption and authentication protections for digital systems
  • Restricting access to authorized staff only
  • Secure transfer procedures for confidential evidence

6. Sharing Information

Information may be shared only when necessary and as authorized or required by law, including with:

  • WSIB / WSIAT / federal agencies administering CPP-D
  • Healthcare professionals and experts
  • Oversight or regulatory authorities as required

Some of our service providers (for example, cloud storage, email, or practice management systems) may store or process information outside Canada, including in the United States. Where this applies, that information may be subject to the laws of the jurisdiction where it is held, including lawful access by foreign authorities.

7. Retention & Destruction

Records are kept only for as long as needed to support representation and comply with legal and regulatory requirements and are then securely destroyed in accordance with our Data Retention Policy.

8. Client Rights

Clients and prospective clients may request:

  • Access to their personal information
  • Corrections to inaccurate records
  • Confirmation of destruction once processed

Requests are handled promptly and securely, with identity verification, and normally within 30 days.

We investigate all complaints and concerns promptly. If you are not satisfied with our response, you may escalate your complaint to:

  • Office of the Privacy Commissioner of Canada — for concerns under PIPEDA (priv.gc.ca)
  • Information and Privacy Commissioner of Ontario — for concerns involving personal health information (ipc.on.ca)

10. Changes to This Policy

We may update this policy periodically to reflect changes in our practices or legal requirements. The effective date below reflects the most recent version.
